1. Overview

Hawk Web Host (“HWH,” “we,” “our,” or “us”) provides managed WordPress hosting, plugins, domains and related API services (collectively “Services”). By purchasing, installing, or using any of these Services you agree to be bound by this Terms of Service (“Agreement”) together with our Privacy Policy and any other guidelines posted on hawkwebhost.com from time to time.

2. Account Requirements

  • You must supply accurate, up-to-date contact information when creating an account and keep it current.
  • You are responsible for all activity that occurs through your credentials, whether or not the actions were authorised by you.
  • You must be at least 18 years old (or the age of majority in your jurisdiction) to hold an account.

3. Plugins & Themes

  • All downloadable assets are released under the GNU GPL.
  • Updates, new features, security patches, and automatic one-click upgrades are delivered only while you have an active paid subscription.
  • Backward compatibility is maintained on a best-effort basis; we target full compatibility with each stable WordPress release within 24 hours of that release.

4. Managed Hosting

  1. Access & data handling
    • You grant us limited permission to access your site files, databases, and server resources solely to provide hosting, backups, and malware remediation, and website changes you request.
    • We may scan anonymised data to improve platform performance and security.
  2. Service Level Commitment (SLA)
    • 99.9 % monthly uptime target (excluding scheduled maintenance and circumstances beyond our control such as natural disasters or 3rd-party failures).
    • If uptime in any calendar month falls below that threshold, you may request a service-credit equal to 5 % of your monthly hosting fee for each full hour of downtime, capped at 100 % of that month’s fee.
  3. Traffic spikes
    • Our plans have no preset bandwidth caps. However, extraordinary surges that degrade platform health may require you to upgrade resources. SLA credits don’t apply during such user-induced overloads.
  4. Account inactivity
    • We hold backups for at least 14 days after a subscription lapses. After that window, we may permanently delete data.

5. Snapshot & Hosting Backups

  • Snapshots are stored in encrypted object storage in the region nearest your account billing address (unless you choose otherwise).
  • Restores can be initiated at any time from your dashboard.
  • You retain all ownership rights to backed-up content; we merely host an encrypted copy for you.

6. API Services

API keys let you programmatically interact with monitoring, optimisation, and licensing endpoints. You agree to:

  • Keep keys confidential.
  • Respect rate limits.
  • Use APIs only for lawful purposes and in line with any published developer guidelines.

7. Prohibited Uses

When using Hawk Web Host Services you will not:

  • Break any applicable law or regulation.
  • Infringe copyright, trademark, or other intellectual-property rights.
  • Publish or transmit harassing, hateful, or discriminatory material.
  • Operate TOR exit nodes, run bulk crypto-mining, or send unsolicited mass email.
  • Host, share, or link to malware, phishing content, or illegal downloads.

8. Payments & Subscriptions

  • Billing cycle. Subscriptions renew automatically each month or year until cancelled.
  • Price changes. We’ll give at least 14 days’ notice via email before any increase.
  • Taxes. You are responsible for any local VAT, GST, or sales tax unless we are legally required to collect it at checkout.
  • Delinquent accounts. Failure to pay within 10 days of renewal may suspend access to Services until the balance is cleared.

9. Refund Policy

  • 30-day money-back guarantee on new hosting plans and memberships — just cancel within the first 30 days and request a refund.
  • Domain registrations, dedicated IPs, and one-time expert services are non-refundable once provisioned.

10. Support

Our WordPress experts are available 24 / 7 via chat or ticket to answer technical, billing, and account questions. We also day time phone support from 8am to 5pm 6 days per week excluding Sundays. We aim to respond within:

  • Chat: under five minutes.
  • Tickets: under 10 minutes
  • Phone: under 10 minutes

11. Security

  • We implement industry-standard firewalls, malware scanning, and intrusion detection.
  • If we detect critical vulnerabilities we may, after notifying you, patch or quarantine affected files to protect your site and the wider platform.
  • You are ultimately responsible for maintaining secure passwords and up-to-date third-party code.
  • We do not guarantee your website will be 100% protected. Due to multiple 3rd party plugins on WordPress, these often come with vulnerabilities that allow hackers to inject scripts, or access the site via back doors. We scan the site daily to look for file changes and catch the issue early and then we investigate how the hackers got in and attempt to “close the door” and terminate their access.

12. Reseller, Clients & Billing

If you resell our Services:

  • You remain Hawk Web Host’s direct customer and are liable for all charges.
  • You must provide first-line support to your end-users.
  • You agree to pass through these Terms (or stricter) to every client site you manage.

13. Domains

  • Domain registrations are managed through accredited registrars.
  • All ICANN policies (including the Uniform Domain Name Dispute Resolution Policy) apply.
  • We are not a party to domain ownership disputes and may suspend a domain if ordered by a court or accredited dispute-resolution body.

14. Email Hosting

  • We do not provide email hosting at this time and recommend clients use Google Workspace. We do provide DNS changes to your MX records to point to your email provider if needed. We solely focus on website hosting and management.

15. Expert & Add-on Services

From time to time we may offer paid one-off services such as performance tuning, proactive monitoring, or malware cleanup. Fees, scope, and turnaround times will be presented before purchase and are non-refundable once work begins.

17. Dispute Resolution & Governing Law

This Agreement is governed by the laws of the State of Georgia, USA (without regard to conflict-of-law principles). Any dispute that cannot be settled amicably within 30 days shall be finally resolved by binding arbitration in Atlanta, Georgia.

18. Third-Party Tools, Integrations & Affiliate Relationships

  1. Recommendations & affiliate links.
    Hawk Web Host occasionally endorses or facilitates add-on services—such as CDN providers, email gateways, analytics suites, backup platforms, or premium plugins—that we believe will benefit your website. Some of these recommendations are delivered through affiliate links or reseller dashboards that allow us to earn a commission or credit when you purchase or subscribe.
  2. Cost-neutral setup.
    When you choose a tool via our affiliate link, we may—at our sole discretion—install, configure, or migrate that service for you at no additional labour charge, because the affiliate commission covers our implementation time. If you acquire the same tool through another channel, standard professional-services rates may apply for setup assistance.
  3. No obligation & independent terms.
    You are never required to use the vendors we suggest, and the decision to purchase remains fully yours. Each third-party product or service is governed by its own licence agreement, privacy policy, and billing practices, which you must review and accept directly with the vendor.
  4. Disclaimer of liability.
    Third-party tools are not part of the “Services” as defined in these Terms. Accordingly, Hawk Web Host makes no warranties—express or implied—regarding their performance, availability, security, or fitness for a particular purpose, and disclaims all responsibility for any loss, damage, or cost arising from their use or malfunction. Your sole remedy for issues related to a third-party product is against the vendor that supplies it.
  5. Conflict-free advice.
    Earning an affiliate commission does not influence our assessment of a tool’s suitability. We recommend only products we would choose for our own projects, and you are free to request alternatives at any time.

19. Changes to These Terms

We may update this Agreement from time to time. When we do, we’ll post the revised version on our website and email the primary account contact at least seven (7) days before changes take effect. Continued use of Services after that date constitutes acceptance of the new Terms.

  • Disclaimer of warranties. Services are provided “as-is” and “as-available.” We expressly disclaim all implied warranties, including merchantability and fitness for a particular purpose.

  • Limitation of liability. (Financial-Loss Disclaimer) 

    No Economic Damage Liability. To the fullest extent permitted by applicable law, Hawk Web Host, its affiliates, officers, employees, and contractors shall not be liable for any direct or indirect monetary loss, lost profits, revenue, business interruption, loss of goodwill, or other consequential, incidental, special, punitive, or exemplary damages arising from (a) server outages, hardware or network failures, or force-majeure events; (b) mistakes, negligence, or misconduct by any Hawk Web Host personnel; or (c) your inability to access or fully operate your website, even if we have been advised of the possibility of such damages.

  • Cap on Direct Damages. In all events, Hawk Web Host’s aggregate liability is limited to the total fees you actually paid us for the specific Service that gave rise to the claim during the twelve (12) months immediately preceding the event. This cap applies regardless of the theory of liability—whether in contract, tort (including negligence), strict liability, or otherwise.

  • Risk Allocation. You acknowledge that (i) website downtime, data loss, coding errors, and other operational risks are inherent in internet services; (ii) you are solely responsible for maintaining independent backups and business-continuity plans; and (iii) the fees you pay to Hawk Web Host reflect this allocation of risk and the limitations of liability set out above.

  • Indemnification. You agree to indemnify and hold HWH harmless from any third-party claims arising out of your use (or misuse) of the Services.
