If you resell our Services:
From time to time we may offer paid one-off services such as performance tuning, proactive monitoring, or malware cleanup. Fees, scope, and turnaround times will be presented before purchase and are non-refundable once work begins.
No Economic Damage Liability. To the fullest extent permitted by applicable law, Hawk Web Host, its affiliates, officers, employees, and contractors shall not be liable for any direct or indirect monetary loss, lost profits, revenue, business interruption, loss of goodwill, or other consequential, incidental, special, punitive, or exemplary damages arising from (a) server outages, hardware or network failures, or force-majeure events; (b) mistakes, negligence, or misconduct by any Hawk Web Host personnel; or (c) your inability to access or fully operate your website, even if we have been advised of the possibility of such damages.
Cap on Direct Damages. In all events, Hawk Web Host’s aggregate liability is limited to the total fees you actually paid us for the specific Service that gave rise to the claim during the twelve (12) months immediately preceding the event. This cap applies regardless of the theory of liability—whether in contract, tort (including negligence), strict liability, or otherwise.
Risk Allocation. You acknowledge that (i) website downtime, data loss, coding errors, and other operational risks are inherent in internet services; (ii) you are solely responsible for maintaining independent backups and business-continuity plans; and (iii) the fees you pay to Hawk Web Host reflect this allocation of risk and the limitations of liability set out above.
This Agreement is governed by the laws of the State of Georgia, USA (without regard to conflict-of-law principles). Any dispute that cannot be settled amicably within 30 days shall be finally resolved by binding arbitration in Atlanta, Georgia.
We may update this Agreement from time to time. When we do, we’ll post the revised version on our website and email the primary account contact at least seven (7) days before changes take effect. Continued use of Services after that date constitutes acceptance of the new Terms.
